E-Conext — Terms of Use and Privacy Policy

This contract states the Terms of Use ("Terms") under which you ("User") may use the E-Conext Sites and the Services (each as defined below).

These Terms constitute a binding agreement between You and E-Conext or the E-Conext company operating the Website for the country in which You live or in which business is headquartered (“E-Conext”), and are deemed accepted by You each time that You use or access any E-Conext Site or E-Conext Services. If You do not accept the Terms stated here, do not use the E-Conext Sites and the E-Conext Services.

E-Conext may revise these terms anytime by posting an updated version on the Internet.

Users who violate these Terms may have their access and use of the E-Conext Sites suspended or terminated, at E-Conext’s discretion.

The provider will try to provide the service without disruptions at all times. Even with the greatest care a disruption cannot be guaranteed. The provider reserves the right to change its offer at any time or decide to discontinue the offer.

You must be 16 years of age or older to visit or use any E-Conext Site in any manner, and, if under the age of 18 or the age of majority as that is defined in Your jurisdiction, must use any E-Conext Site under the supervision of a parent, legal guardian, or other responsible adult.

The web pages of E-Conext be defined as any websites under control of E-Conext and include the E-Conext services. The E-Conext services are defined as applications and E-Conext services offered, including an online service for publishing and search of vacancies as well as any application and / or any mobile phone or any interface that provides access to such applications. The E-Conext websites include online communities and communication tools for the formation of valuable professional and personal networks ("E-Conext Networks") between the users of E-Conext websites ("User"). In addition, users can create the E-Conext websites individual profiles that contain personal information ("Profile"). They also have the opportunity to make these profiles or parts of it public.

Furthermore, E-Conext can collect information about you from publicly available websites and create from this information a profile or attach it to an existing profile.

1. Use of E-Conext Content

All content on the E-Conext Sites is the exclusive property of E-Conext and is protected by copyright, trademark, and other laws. Unauthorized use of the E-Conext Content may violate these laws and/or applicable communications regulations and statutes, and is strictly prohibited. You must preserve all copyright, trademarks, service mark and other proprietary notices contained in the original E-Conext Content on any authorized copy You make of the E-Conext Content.

Any code that E-Conext creates to generate or show content is protected by copyright.

You are not allowed to duplicate, alter, discredit or adjust E-Conext Content that dilutes the strength of E-Conext or infringes with intellectual property rights. Use of E-Conext content on any other site is strictly prohibited.

2. E-Conext Services

The E-Conext Sites may be used only by individuals seeking employment and/or career information and by employers seeking employees and knowledge sharing. In addition, E-Conext Networking and Profiles may be used by individuals for permitted professional and personal networking purposes. Your use of the E-Conext Services is also subject to any other contracts the user may have with E-Conext. In the case of any conflict between these Terms and any contract you have with E-Conext, the terms of your contract will prevail. Posting is any information that the user publishes.

All E-Conext Users agree to not:

(1) Use any device to navigate or search any E-Conext Site other than the tools available on the Site, generally available third party web browsers, or other tools approved by E-Conext;

(2) Use any data mining, robots or similar data gathering or extraction methods;

(3) Violate or attempt to violate the security of any E-Conext Site including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;

(4) Aggregate, copy or duplicate in any manner any of the E-Conext Content or information available from any E-Conext Site, including expired job postings, other than as permitted by these Terms;

(5) Use another device to navigate or search on a Web page by E-Conext, as available on the website tools generally available third-party browsers or other tools that have been approved by E-Conext;

(6) Link or frame to any E-Conext Content or information available from any E-Conext Site, unless permitted by these Terms;

(7) Post any content or material that promotes or endorses false or misleading information or illegal activities, or endorses or provides instructional information about illegal activities or other activities prohibited by these Terms, such as making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses or pirating media;

(8) Post any CV or Profile, or apply for any job on behalf of another party;

(9) Defer any contact from an employer to any agent, agency, or other third party;

(10) Share with a third party any login credentials to any E-Conext Site;

(11) Access data not intended for You or logging into a server or account which You are not authorized to access;

(12) Post or submit to any E-Conext Site any incomplete, false or inaccurate biographical information or information which is not Your own;

(13) Post content that contains restricted or password-only access or hidden images;

(14) Solicit passwords or personally identifiable information from other Users;

(15) Delete or alter any material posted by any other person or entity;

(16) Harass, incite harassment or advocate harassment of any group, company, or individual;

(17) Attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any E-Conext Site, overloading, "flooding", "spamming" or "crashing";

(18) Promote or endorse an illegal or unauthorized copy of another person's copyrighted work, such by as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

(19) Use the E-Conext Services for any unlawful purpose or any illegal activity, or post or submit any content, CV, or job posting that is defamatory, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by E-Conext’s discretion;

(20) Post any CV which is not a genuine CV and which attempts to advertise or promote products or services.

Violations of system or network security may result in civil and/or criminal liability. E-Conext will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

You are responsible for maintaining the confidentiality of the User account, Profile and passwords, as applicable. You may not share Your password or other account access information with any other party, temporarily or permanently, and You shall be responsible for all uses of Your E-Conext Site registrations and passwords, whether or not authorized by You. You agree to immediately notify E-Conext of any unauthorized use of Your account, Profile, or passwords.

3. Additional terms applicable to Employers

Employers are solely responsible for their postings on E-Conext sites. E-Conext is not an employer.

You understand and acknowledge that all your information, CVs, Job Journals, and Processes will be deleted from E-Conext's databases when a contract is terminated. Information may continue to be available for some period until final deletion thereof.

Job postings

You may not use Your E-Conext job posting or E-Conext to:

(1) Advertise jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labour and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;

(2) Advertise jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job;

(3) Advertise jobs that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract;

(4) Advertise jobs or other advertisements for competitors of E-Conext or post jobs or other content that contains links to any site competitive with E-Conext;

(5) Advertise sexual services or seek employees for jobs of a sexual nature;

(6) Advertise any franchise, pyramid scheme, "club membership", distributorship, multi-level marketing opportunity, or sales representative arrangement;

(7) Advertise any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling;

(8) Advertise any business opportunity that requires an upfront or periodic payment or requires recruitment of other members, sub-distributors

(9) Request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;

(10) Advertise any jobs on any E-Conext Site for modelling, acting, talent or entertainment agencies or talent scouting positions;

(11) Sell, promote or advertise products or services;

(12) Promote a particular religion;

(13) Endorse a particular political party, political agenda, political position or issue;

(14) Except where allowed by applicable law, advertise jobs which require the applicant to provide information relating to his/her (a) racial or ethnic origin (b) political beliefs (c) philosophical or religious beliefs (d) membership of a trade union (e) physical or mental health (f) sexual life (g) the commission of criminal offences or proceedings.

A Job posting may not contain:

(1) Any hyperlinks, other than those specifically authorised by E-Conext;

(2) The names, logos or trademarks of unaffiliated companies other than those of your customer save where expressly reed by E-Conext;

(3) The names of colleges, cities, states, towns or countries that is unrelated to the posting;

(4) More than one job or job description, more than one location, or more than one job category, unless the product so allows;

(5) Inaccurate, false, or misleading information; and

(6) Material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 16.

E-Conext reserves the right to remove any job posting or content from any E-Conext Site, which in the reasonable exercise of E-Conext’s discretion, does not comply with the above Terms, or if any content is posted that E-Conext believes is not in the best interest of E-Conext.

If at any time during Your use of the E-Conext Services, You made a misrepresentation of fact to E-Conext or otherwise misled E-Conext in regards to the nature of Your business activities, E-Conext will have grounds to terminate Your use of the E-Conext Services.

Use of the E-Conext Curriculum Vitae (CV) Database by Employers

You shall use the E-Conext CV Database in accordance with all applicable privacy and data protection laws, and You agree You shall not further disclose any of the data from E-Conext CV Database to any third party and use the Database explicitly for recruiting purposes.

You need to take appropriate action to protect information from the CV Database against third parties and general misuse.

The E-Conext Curriculum Vitae (CV) Database shall not be used:

(a) to carry out unsolicited phone calls or send faxes, mail, e-mails or newsletters to holders of a curriculum vitae or take other people’s contacts, unless they have consented (if consent is necessary). In cases where express consent is required, it has to be obtained.

(b) for purposes other than the search for employees by an employer, in particular for the promotion of actions, products or services;

To ensure a safe and effective user experience for all of our customers to e-Conext reserves the right to restrict users' rights.

4. Additional terms applicable to Job Seekers

Any Profile You submit must be accurate and describe You, an individual person. The Profile requires standard fields to be completed and you may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting You, other than Your last name and URLs.

You acknowledge and agree that You are solely responsible for the form, content and accuracy of any CV or material contained therein placed by You on the E-Conext Sites.

E-Conext reserves the right to offer third party services and products to You based on the preferences that You identify in Your registration and at any time thereafter or you have agreed to receive, such offers may be made by E-Conext or by third parties. Please see E-Conext's Privacy for further details regarding Your Information.

You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your E-Conext account or Your E-Conext account is terminated, all Your account information from E-Conext, including CVs, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted in and may be deleted from E-Conext's databases and will be removed from any public area of the E-Conext Sites. Information may continue to be available for some period of time because of delays in probating such deletion through E-Conext’s web servers. In addition, third parties may retain saved copies of Your Information.

E-Conext reserves the right to delete Your account and all of Your Information after a significant duration of inactivity.

With the use of this website there will be no contractual relationship between the job seeker/user and the provider only between the companies and the provider. To that extent also no contractual claims can be made against the provider.

5. User Content and Submissions

You understand that all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messes or other materials submitted, posted or displayed by You on or through a E-Conext Site is the sole responsibility of the person from which such User Content originated. E-Conext claims no ownership or control over any User Content.

You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any User Content you submit, post or display on or through E-Conext. By submitting, posting or displaying User Content on or through E-Conext, you grant E-Conext a, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, adapt, distribute and publish such User Content through E-Conext. In addition, by submitting, posting or displaying User Content which is intended to be available to the general public, you grant E-Conext a, non-exclusive, royalty-free license to reproduce, adapt, distribute and publish such User Content for the purpose of promoting E-Conext and its services. E-Conext will discontinue this licensed use within a commercially reasonable period after such User Content is removed from E-Conext. E-Conext reserves the right to refuse to accept post, display or transmit any User Content in its sole discretion.

You also represent and warrant that You have the right to grant, or that the holder of any rights, including moral rights in such content has completely and effectively waived all such rights and validly and irrevocably granted to You the right to grant, the license stated above. If You post User Content in any public area of any E-Conext Site, You also permit any User to access, display, view, store and reproduce such User Content for personal use. Subject to the foregoing, the owner of such User Content placed on any E-Conext Site retains any and all rights that may exist in such User Content. E-Conext may review and remove any User Content that, in its sole judgment, violates these Terms, violates applicable laws, rules or regulations, is abusive, disruptive, offensive or illegal, or violates the rights of, or harms or threatens the safety of, Users of any E-Conext Site. E-Conext reserves the right to expel Users and prevent their further access to the E-Conext Sites and/or use of E-Conext Services for violating the Terms or applicable laws, rules or regulations. E-Conext may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes that such User Content could create liability for E-Conext, damage E-Conext’s brand or public image, or cause E-Conext to lose Users or (in whole or in part) the services of its ISPs or other suppliers.

E-Conext does not represent or guarantee the truthfulness, accuracy, or reliability of User Content, derivative works from User Content, or any other communications posted by Users nor does E-Conext endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at Your own risk.

Prohibited is content that:

(1) is implicitly or explicitly offensive, such as User Content that endorses or promotes racism, discrimination, hatred or physical harm of any kind against any group or individual;

(2) involves the transmission of “junk mail”, “chain letters,” or unsolicited mass mailing, “spamming” or “phishing”;

(3) promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene or defamatory

(4) promotes or endorses an illegal or unauthorized copy of another person's copyrighted work, such as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

(5) displays or links to pornographic, indecent or sexually explicit material of any kind;

(6) provides or links to material that exploits people under the age of 18 in a sexual, violent or other manner, or solicits personal information from anyone under 18; or

(7) provides instructional information about illegal activities or other activities prohibited by these Terms, including without limitation, making or buying illegal weapons, violating someone's privacy, providing or creating computer viruses or pirating any media; and

(8) Solicits passwords or personal identifying information from other Users.

(9) restricted or password-protected sites include, or hidden pages or images.

You may not include, in any User Content submitted to E-Conext Networking, information that may be interpreted as a direct solicitation, advertisement or recruitment for an available job position directed to individuals seeking employment on either a full time or part time basis, in order to protect our E-Conext Community Users from commercial advertising or solicitation.

E-Conext reserves the right to restrict the number of e-mails or other messes which a User may send to other Users to a number which E-Conext deems appropriate in its sole discretion.

Profiles derived from User Content may also be made available through the E-Conext Sites. E-Conext does not make any representations regarding the accuracy or validity of such derived works or their appropriateness for evaluation by employers. Derived Profiles may differ significantly from User Content.

6. E-Conext's Liability

The E-Conext Sites act as, among other things, venues for employers to post job opportunities and search for and evaluate job candidates and candidates to post CVs and Profiles and search for and evaluate job opportunities or knowledge exchange. E-Conext does not screen or censor the listings, including Profiles offered. E-Conext is not involved in, and does not control, the actual transaction between employers and candidates.

As a result, E-Conext is not responsible for User Content, the quality, safety or legality of the jobs or CVs posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings and E-Conext makes no representations about any jobs, CVs or User Content on the E-Conext Sites. While E-Conext reserves the right in its sole discretion to remove User Content, job postings, CVs or other material from the E-Conext Sites from time to time, E-Conext does not assume any obligation to do so and to the fullest extent permitted by law, disclaims any liability for failing to take any such action.

E-Conext Networking provides a venue for individuals to network for professional and personal purposes and E-Conext does not screen or censor the Profiles or User Content on the E-Conext Sites. E-Conext is not involved in the actual communications between Users. As a result, E-Conext has no control over the accuracy, reliability, completeness, or timeliness of the Profiles or User Content submitted on the E-Conext Sites and makes no representations about any Profile or User Content on the E-Conext Sites.

Note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, other persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom You come in contact through the E-Conext Sites. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceptively labelled. We expect that You will use caution and common sense when using the E-Conext Sites.

Because User authentication on the Internet is difficult, E-Conext cannot and does not confirm that each User is who they claim to be. Because we do not and cannot be involved in User-to-User dealings or control the behaviour of participants on any E-Conext Site, in the event that You have a dispute with one or more Users, You release E-Conext (employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.

The E-Conext Sites and the E-Conext Content may contain inaccuracies or typographical errors. E-Conext makes no representations about the accuracy, reliability, completeness, or timeliness of any E-Conext Site or the E-Conext Content. The use of all E-Conext Sites and the E-Conext Content is at Your own risk. Changes are periodically made to E-Conext Sites and may be made at any time.

E-Conext cannot guarantee and does not promise any specific results from use of any E-Conext Site. No advice or information, whether oral or written, obtained by a User from E-Conext or through or from any E-Conext Site shall create any warranty not expressly stated herein.

As a Polish resident, You acknowledge that on the basis of Article 558 ss 1 of the Polish Civil Code, E-Conext’s warranty for the physical and legal defects of the offered products/services is excluded.

As a California resident, You waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."

E-Conext encourages You to keep a back-up copy of any of Your User Content. To the extent permitted by law, in no event shall E-Conext be liable for the deletion, loss, or unauthorized modification of any User Content.

E-Conext does not provide or make any representation as to the quality or nature of any of the third party products or services purchased through any E-Conext Site, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of such third party products or services, under the terms reed to by the provider.

If notified of any content or other materials which allegedly do not conform to these Terms, E-Conext may in its sole discretion remove any content. E-Conext takes no liability or responsibility for any content.

7. Copyright or Trademark Infringement

If You believe that Your copyrighted work or trademark has been uploaded, posted or copied to any E-Conext Site and is accessible on such E-Conext Site in a way that constitutes copyright or trademark infringement, please contact E-Conext by email at info@e-conext.com or by regular mail to:

8. Warranty

E-Conext does not warrant that any E-Conext site or any E-Conext services will operate error-free or that any E-Conext site and its servers are free of viruses or other harmful mechanisms. If your use of any E-Conext site or the E-Conext content results in the need for servicing or replacing equipment or data or any other costs, E-Conext is not responsible for those costs. The E-Conext sites and E-Conext content are provided on an as current basis without any warranties of any kind. E-Conext disclaims all warranties to the fullest extent of the law, including the warranty of merchantability, fitness for particular purpose or non-infringement. E-Conext makes no warranties about the accuracy, reliability, completeness, or timeliness of the E-Conext content, services, software, text, graphics or links.

9. Damages

Possible by law, in no event shall E-Conext, its suppliers, or any third parties mentioned on any E-Conext site be liable for any damages or whatsoever (including, without, limitation, coincidental and consequential damages, lost profits or damages resulting from data losses, lost employment opportunity or business interruption) resulting from the use or inability to use any E-Conext site and the E-Conext content, whether based on warranty, contract, tort or any other legal matter.

10. Limitation of Liability

To the fullest extent possible by law, E Conext’s maximum liability arising out of or in connection with any E-Conext site or your use of the E-Conext content, regardless of the cause of action (whether in contract, breach of warranty or otherwise), will not exceed CHF10.

11. Resale or Unauthorized Commercial Use

You agree not to sell or cede your rights or duties mentioned in these Terms. You also agree not to use any of the E-Conext Websites in an unauthorized commercial way.

12. Links to Other Websites

The E-Conext Sites contain links to third party Web sites. These links are provided solely as a convenience to You and not as an endorsement by E-Conext of the contents on such third-party Web sites. E-Conext is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such.

13. Infringement of The Copyright or Other Intellectual Property Rights

As a condition of your use of the site by E-Conext You agree to use them in any way to the infringement of intellectual property. E-Conext reserves the right to terminate the accounts of all users and all users to block access to the websites of E-Conext who repeatedly infringe the copyright or other rights of third parties to intellectual property.

E-Conext reserves the right to carry out these measures in its sole discretion, to restrict access to the site and/ or the account to cancel at any time, regardless of whether it is a repeated violation or not. This happens with or without notice and without liability to the user, the access to which is blocked or terminated.

E-Conext respects the intellectual property of others, and we ask our users and content partners to do the same. Unauthorized publication, reproduction, copying, distribution, modification, public display or public performance of copyrighted works is an infringement of copyright of the owner.

14. Indemnity

You agree to defend, indemnify, and hold harmless E-Conext, its affiliates, and their respective officers, directors, employees, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from any User Content or other material You provide to any E-Conext Site, Your use of any E-Conext Content, or Your breach of these Terms. E-Conext shall provide notice to You promptly of any such claim, suit, or proceeding.

15. Mobile Usage

If You use the E-Conext Sites through a mobile device, You agree that information about Your use of the E-Conext Sites through Your mobile device and carrier may be communicated to us, including but not limited to Your mobile carrier, Your mobile device, or Your physical location. In addition, use of the E-Conext Sites through a mobile device may cause data to be displayed on and through Your mobile device.

By accessing the E-Conext Sites using a mobile device, You represent that to the extent You import any of Your E-Conext data to Your mobile device that You have authority to share the transferred data with Your mobile carrier or other access provider. In the event You change or deactivate Your mobile account, You must promptly update Your E-Conext account information to ensure that Your messes are not sent to the person that acquires Your old number and failure to do so is Your responsibility.

You acknowledge You are responsible for all charges and necessary permissions related to accessing the E-Conext Sites through Your mobile access provider.

Therefore, You should check with Your provider to find out if the E-Conext Sites are available and the terms for these services for Your specific mobile devices.

By using any downloadable application to enable Your use of the E-Conext Sites, You are explicitly confirming Your acceptance of the terms of the End User License agreement associated with the Application provided at download or installation, or as may be updated from time to time.

16. General

E-Conext makes no claims or representations that the E-Conext Content may be lawfully viewed or accessed outside of Germany, Austria and Switzerland. Access to the E-Conext Content may not be legal by certain persons or in certain countries.

If You access any E-Conext Site You do so at Your own risk and are responsible for compliance with the laws of Your jurisdiction. By downloading or using such software, You represent and warrant that You are not located in, under the control of, or a national or resident of any such country, that underlies USA embargoes, individual, or entity on any such list:

(a) (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria or any other country which is subject to a trade embargo imposed by the United States, or be passed on to

(b) a person or company who / which is on the list of "Specially Designated Nationals" of the US Treasury Department or the list "Table of Deny Orders" of the US Commerce Department.

These Terms are governed by the laws of Switzerland. Jurisdiction for any claims arising under this agreement shall lie exclusively with the Swiss courts. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. If You decide to access linked third-party Web sites, You do so at Your own risk.

17. Terms of Contract and Termination

These Terms will remain in full force and effect while You are a User of any E-Conext Site. E-Conext reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of Your User Content from the E-Conext Sites and immediate termination of Your registration.

In the event that you are no longer an E-Conext users, some provisions of this Agreement remain.

The contract for the use of the E-Conext platform is signed for an indefinite period of time.

The contract is concluded for the duration of the accounting period (one or two years). The contract is automatically extended at the end of the accounting period by 1 year, if it is not terminated according to the terms by one party. The contract may be terminated by either party through a notice and the notice period of three (3) months prior to the end of the contract.

In the event of termination, the entire profile and the company's network will be deleted.

The extraordinary termination remains unaffected.

18. Commission

E-Conext will charge its Partners a commission of each booking from orders placed through the E-Conext platform. Commissions may change at the discretion of E-Conext. For an order to generate a commission to E-Conext, the user must complete the order form and remit full payment for the product/ service ordered through the secure payment system on E-Conext.

19. Payment

E-Conext pays partners via online transfer, details provided on the signed contract at the beginning of the partnership. If the details change, it is the responsibility of the partner to notify the E-Conext to ensure proper commission payments. We will not resend payments returned due to incorrect payment details. E-Conext will transfer the accumulated amount of the cleared funds (after commission charged), to the Partners bank account.

20. Order Fulfillment

Users who purchase a service through the E-Conext Platform will be directed to the partner after the purchase is made to receive all further details about their purchase. E-Conext will not provide any additional information about the service to the user after purchase.

21. Return and Refund

Unless otherwise stated, services purchased through E-Conext are not returnable nor refundable after purchase.

This policy applies to information we collect or use on sites and applications owned or controlled by E-Conext AG, or its affiliated companies ("E-Conext").

E-Conext is not responsible for the privacy policies or practices of advertising networks and other websites, third parties with whom we work to provide you personalized services, or those who access your information on our sites or applications.

We collect information about you when you use E-Conext. We collect information directly from you such as your contact information, CV, and profile information. We also collect information about you automatically such as how you use and interact with E-Conext, your demographic information, and information about your computer or mobile device.

We may collect or use information about you from publicly-available websites whether or not you have an account with us. You will have the opportunity to claim, change the visibility setting of, or remove the information. However, we cannot guarantee that we will not later collect from publicly-available websites other information that pertains to you.

We may also acquire information about you from third parties to further personalize and enhance your experience.

Data has been determined by E-Conext from the following sources among others: company websites and homepages, Companies House or Companies Register, own research, other public registers.

2. Store Information

We store your information to make your interaction with E-Conext more efficient, practical, and relevant. You may access, review, correct, update, or delete your CV or profile any time by logging in to your account. If you do not have an account, please contact us.

When you delete your personal information, we will retain a log of information and will retain a copy of information for any content that might have to be legally accessed by third parties.

Upon request, the user has the right, to receive information on the personal data stored about him/her.

3. How We Use Information

We use the information we collect about you to deliver the products and services we offer, respond to you, and operate and improve our sites and applications. Our services include showing you personalized content and advertising on E-Conext or other sites with which we have a business relationship. We may use your information to contact you about E-Conext updates, conduct surveys, or to provide informational and service-related communications, including important security updates.

Information you share in public areas of E-Conext or make visible in the CV and profile database may be accessed, used, and stored by others around the world. We strive to provide a safe environment by attempting to limit access to our database to legitimate users, but we cannot guarantee that unauthorized parties will not gain access. We also cannot control how authorized users store or transfer information you give to us, so you should not post sensitive information to E-Conext Sites.

We share your information with third parties who help us deliver our products and services to you. These third parties may not use your information for any other purpose.

We may share information to third parties if you consent. For example, we may use your information to contact you about products or services available from E-Conext or our affiliates. If you opt in, we may supply your information to third parties who may contact you about their products or services.

We may disclose to third parties information that we have collected from other websites.

We disclose information where legally required.

We may disclose and transfer information to a third party who acquires any or all of E-Conext business units.

Users are informed via Email about changes in their profile. Solely the Email provided will be used to inform the user of any such updates.

“Newsletters” are excluded from any such contact. In order to receive the newsletter, the user will have to select this option while registering or change it in the profile settings.
